Waiver and Release of Liability

You acknowledge that the KoopAI app is designed primarily as a virtual running coach, providing training plans, coaching advice, and progress tracking. However, similar to general-purpose chatbots, KoopAI allows users to engage in conversations on a wide range of topics, including those beyond the scope of running and fitness. As a result, any advice or guidance provided by the Service may pertain to various subjects.

1.3 Unpredictable Guidance and Hallucinations

The KoopAI app is powered by a large language model that may occasionally generate responses that are incorrect, misleading, or outside the intended scope of the Service (a phenomenon known as "hallucinations"). You acknowledge and understand that:

• The advice or guidance provided by the Service may be unpredictable or inaccurate due to these hallucinations.
• SeakelpAI, Inc. makes no guarantees about the accuracy or reliability of the content provided by the Service, and you should consult appropriate professionals before acting on any advice.
• The advice provided by KoopAI is not intended as a substitute for professional medical, fitness, psychological, or any other specialized advice, diagnosis, or treatment.

2. Acknowledgment of Risk

2.1 Voluntary Participation

By using the KoopAI app, you voluntarily assume all risks associated with the Service. You acknowledge that you are responsible for your own health, safety, and well-being while using the app and that you should consult with a qualified healthcare professional before following any advice or workout plans provided by the Service.

2.2 Acknowledgment

To formalize your understanding and acceptance of these risks, you will be asked to check a box indicating that you have read, understood, and agree to this Waiver. By checking this box, you confirm your acceptance of all terms and conditions outlined in this document.

3. Waiver of Claims

3.1 Comprehensive Waiver

In consideration of your use of the KoopAI app, you hereby waive any and all claims, causes of action, or demands against SeakelpAI, Inc., its officers, employees, contractors, affiliates, and any other associated parties ("Released Parties"), arising out of or related to your use of the Service, including but not limited to:

• Claims for personal injury, serious injury, or death.
• Claims for property damage.
• Claims for any financial or emotional loss.
• Claims related to any advice or guidance provided by the Service on any topic, including but not limited to erroneous, inaccurate, or hallucinated responses from the chatbot.

3.2 Limitations or Exclusions

This Waiver applies to any and all claims, including those resulting from negligence or other fault of the Released Parties, to the maximum extent permitted by law.

4. Release Language

4.1 Release of Liability

By signing this Waiver, you release, waive, and discharge SeakelpAI, Inc. and the Released Parties from any and all liability, claims, demands, or causes of action that may arise from your use of the KoopAI app, whether caused by the negligence of the Released Parties or otherwise, including but not limited to:

• Physical injuries sustained while following a workout or exercise plan provided by the Service.
• Health complications arising from the use of the Service.
• Any adverse effects resulting from following advice or guidance provided by the Service on any topic, including inaccurate or hallucinated responses from the chatbot.

4.2 Indemnification

You agree to indemnify, defend, and hold harmless SeakelpAI, Inc. and the Released Parties from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of or related to your use of the KoopAI app.

5. Monitoring of Conversations

To enhance the performance of the KoopAI app and improve user experience, SeakelpAI, Inc. regularly monitors and reviews user conversations with the chatbot. By using the Service, you acknowledge and agree that:

• SeakelpAI, Inc. may access and review your conversations with the chatbot for the purposes of evaluating, improving, and ensuring the functionality of the Service.
• Any data collected during this process will be handled in accordance with our Privacy Policy and treated with confidentiality and care.

6. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

7. Final Agreement

This Waiver constitutes the entire agreement between you and SeakelpAI, Inc. regarding your use of the KoopAI app. If any provision of this Waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.
